Watch out for these mistakes in NIL deals

Name, image and likeness for athletes in college has been called the Wild West. Each state has different laws, the NCAA doesn’t shed insight, and everyone is trying to be an expert.

However, not everyone speaking LOUDLY is speaking accurately. Here are some things to watch out for when looking at NIL deals as a college athlete:

1. You don’t have to sign exclusively with an agent or marketing expert to get deals. You are able to work on specific deals with a variety of different people. Don’t just hop in bed with the first company that calls you “pretty”.

2. Check to see if you are giving up future rights. Some deals require exclusivity and don’t allow you to work with other brands during or after your contract ends.

3. Don’t exclude whole categories like “Fitness” when there are subcategories like “Sports Drinks” that might be a better fit.

4. Always look at each deal with a longterm vision. Just because money or product in your pocket now seems good, doesn’t mean it is good. Sometimes partnerships dilute your personal brand in the long-term.

5. ALWAYS remember to put #Ad #Sponsored or the like on your posts. The FTC regulates this type of marketing and you could be in hot water if you don’t disclose partnerships accurately and conspicuously.
